The following provisions, hereinafter referred to as the “Acceptable Use Policy” (AUP), are intended to ensure responsible use of the Internet, the infrastructure, and the services provided by MV Studio (hereinafter the “Network”), as well as to prevent any practice that may disrupt the use and performance of the infrastructure and/or the data communication network.
This AUP defines the conditions considered acceptable for using MV Studio’s Network and infrastructure.
The Client agrees to fully comply with this Acceptable Use Policy at all times and, upon MV Studio’s request, to formally confirm their compliance.
The Client may only use the Network and infrastructure for lawful purposes. Any use of the Network or infrastructure that is in violation of applicable laws or regulations is strictly prohibited (e.g., transmitting copyrighted material without authorization, infringing upon third-party privacy, providing illegal, harmful, or offensive content, or violating intellectual property rights, etc.), regardless of whether the Client is aware of the content or the applicable law.
MV Studio reserves the right to immediately remove any inappropriate content and/or block access to all or part of the Network if such use is deemed non-compliant with this AUP.
MV Studio will not disclose any of the Client’s email addresses or other personal data to third parties without the Client’s prior written consent, except where legally required or in the context of a legal investigation to which MV Studio will fully cooperate.
The Network may be used by the Client to connect to other networks worldwide. The Client agrees to comply with the acceptable use policies of those networks. Any breach of the security of a system or network may result in civil or criminal liability for the Client. MV Studio will fully cooperate with the competent authorities in the event of an investigation into alleged offenses.
The Client is not permitted to:
MV Studio’s AUP does not impose a fixed limit on the use of shared infrastructure. We rely on average, reasonable, and proportional use relative to the solution purchased. As long as your usage does not cause an overload affecting other clients, it remains within acceptable limits.
This AUP aims to ensure that our products and services are used in accordance with their design principles and core functionalities. Our offering is structured to avoid any significant overload as long as usage remains reasonable.
The Client shall not send emails or other forms of electronic communication to recipients who have not consented to receive them. It is strictly prohibited to send unsolicited messages on a large scale (spam, advertisements, propaganda, etc.) or to post the same message in multiple media groups (Usenet spam).
The Client shall not forward or distribute chain letters or malicious emails.
Any deceptive modification or falsification of identifying information in network headers (to hide the sender or mislead recipients) is forbidden. The Client may not impersonate another person through falsified headers or other deceptive methods.
MV Studio reserves the right to suspend any Service related to the relevant request:
Any breach of this AUP is deemed a substantial violation of the General Terms and Conditions of the Agreement binding MV Studio and the Client.
The Client agrees to indemnify and hold MV Studio harmless against:
MV Studio (including its subsidiaries) complies with Regulation (EU) No 2022/2065 – the Digital Services Act (DSA). Users are responsible for any content they upload, share, or make available through our Services. Any content that violates the DSA, applicable law, or our General Terms and Conditions may be removed, and its author may face suspension or account termination.
MV Studio will work with competent authorities in accordance with applicable regulations and the DSA, including by providing information (including personal data) and facilitating investigations. A central point of contact is available at info@mvstudio.be (the “Abuse Email Address”).
If any individual or entity discovers that specific content hosted by MV Studio is illegal, they can contact MV Studio via the Abuse Email Address and submit a report (hereinafter the “Report”) that meets the following conditions:
Upon receiving a report, MV Studio will send an acknowledgment of receipt to the submitter. If the report meets all requirements, MV Studio will inform the individual or entity of its decision, along with the reasons behind it. MV Studio is not required to perform an exhaustive legal analysis of the reported facts, but must conduct an assessment consistent with what is expected of a diligent hosting provider.
If the individual or entity disagrees with MV Studio’s decision, they may raise the issue again via the Abuse Email Address, explaining the reasons for their disagreement. MV Studio will review the request and communicate its final decision. Furthermore, the individual or entity may bring any allegedly illegal content to the attention of the competent authorities at any time.
In accordance with the DSA, MV Studio may publish reports describing its content moderation actions (such as the quantity and nature of removed content, as well as suspended or terminated accounts).
